Legal Notice – Hearing for Unsafe Building

A. Description of Premises:
28 Rewey Avenue , Village of Newark Valley, Town of Newark Valley, County of Tioga, State of New York Tax Map No.:_64.19-1-34
Owner: Laura M. DeMais by Warranty Deed of Frank Perretta and Elizabeth Perretta dated October 20, 2006 and recorded in the Tioga County Clerk’s Office on December 12, 2006 as Instrument No. 139412-001
B. The building on the above premises is unsafe and dangerous and in violation of the following provisions of Article 66 (Buildings, Unsafe) of the Code of the Village of Newark Valley in the following respects:
- Lack of roof for over 1 years allowing water infiltration;
- Structural integrity has been compromised due to rotting;
- Floors buckling and warping;
- Charred walls & roof framing due to past fire damage;
- Unsanitary due to mold and mildew growth;
- No septic system.
C. The building is to be made safe and secure or demolished and removed in the following manner:
1. Roof framing must be replaced and made structurally sound, and appropriate roofing applied;
2. Charred framing on second floor walls must be replaced and or otherwise remediated;
3. Ledger board on second floor must be replaced;
4. Mold and mildew growth must be eliminated;
5. Operating septic system needed;
6. Or otherwise demolition.
D. The securing or removal of such building shall commence within 30 days of the service of the notice and shall be completed within 60 days thereafter, unless, for good cause shown, such time shall be extended.
E. A hearing on the matter will occur on August 17, 2010 at 7:00 pm at the Board Room of the Village of Newark Valley, 9 Park Street, Newark Valley, NY 13811.
F. In the event of neglect or refusal to comply with the order to secure or demolish and remove the building, the Board of Trustees is authorized to provide for its demolition and removal, to assess all expenses thereof against the land on which it is located and to institute a special proceeding to collect the costs of demolition, including legal expenses.
